E-service regulations

The regulations of service provision with electronic means of the Internet shop

operating under the website domain www.nidiesque.pl

These regulations is the regulations of electronic service provision specified in Art. 8 of section 1 of the Act of 18 July 2002 on on service provision with electronic means.

Definitions of the terms used in the Regulations:

Regulations - these regulations specifying the principles and procedures of use of services provided with electronic means in the scope of the conducted Internet shop, hereinafter and on the website referred to as “the regulations of service provision with electronic means” or interchangeably “e-service regulations”.

Tadeusza Kościuszki 43, 05-270 Marki, entered in the Register of Entrepreneurs of the National Court Register for the capital city of Warsaw in Warsaw, XIV Economic Division of the National Court Register under KRS no. 0000556526, with share capital of PLN 750,750.00, with NIP tax identification number: 125 16 32 838, Regon number: 361408655.

Customer - a natural person, legal person and organisational unit without legal personality which uses the services provided with electronic means made available by the Service Provider.

Websitea HTML document (i.e. text file read by the Internet browser) made available on the Internet under domain www.kfniccolum.pl

Internet shopthe website conducted by the Service Provider, allowing for placing orders with the use of means of remote communication, hereinafter referred to as the “Internet shop”.

Tele-information systeman assembly of matching IT devices and software, ensuring processing and storage as well as sending and receiving data through telecommunication networks with the end-user device appropriate for a given type of telecommunication network (e.g. laptop, telephone).

Account - a set of resources designated with an individual name (login) and password chosen by the Customer in the Service Provider’s tele-information system where the Customer’s data made available during account creation is collected, including information on placed order/s.

Login - a sequence of letters, digits and other characters, identifying the Customer as the user of the created account.

Password - a sequence of letters, digits or other characters, protecting and, at the same time, allowing for access to a specific account with the login assigned to it.

Electronic order form - a graphical interface, allowing for placing an order in the Internet shop.

Information bulletin newsletternewsletter on novelties and promotions connected with the sales of goods presented on the Internet shop’s website sent via electronic way (to the e-mail address specified by the Customer).

Product/goods - an moveable object presented in the Internet shop, constituting the subject of the sales contract.

Product/goods sheetthe goods description, including its photo, price and availability, displayed by the system on the Internet shop’s website.

CHAPTER I: General provisions.

1. These regulations specify the terms and conditions of use of services provided with electronic means within the scope of conducted website, operating under domain www.nidieque.pl.

2. In connection with service provision with electronic means via website, the Service Provider uses the software and coding technology that ensure security, confidentiality, privacy and integrity of submitted data/information.

3. For the purpose of assurance of appropriate protection from threats arising from connection with the Internet web, in relation to service provision with electronic means, the Customers are recommended to apply appropriate software protecting from e.g. viruses, internet bugs type (worm), including other software performing actions not intended by the Customer and resulting in threats connected with service provision with electronic means on their hardware.

4. Services provided with electronic means by the Service Provider are free of charge.

5. The Customers are forbidden from providing contents with unlawful nature or interfering with the technology of the Internet shop in the manner contradictory to the law.

CHAPTER 2: The types and range of services provided with electronic means in the scope of conducted website.

1. The Service Provider, in the scope of the conducted website, provides electronic services which consist in:

- concluding sales contracts for goods presented in the Internet shop with the use of registration/order forms, including other measures of remote communication (active e-mail post)

- keeping the account in the Internet shop,

- information bulletin newsletter subscription, i.e. sending current information on promotions and novelties connected with the product range of the Internet shop to the e-mail address specified by the Customers.

CHAPTER 3: Technical requirements necessary for cooperation with the tele-information system used by the Service Provider.

The use of service provided in the scope of the conducted Internet shop via electronic manner is possible upon fulfilment of the following technical requirements by the Customers’ tele-information system:

- access to the electronic equipment connected to the public network (Internet), including by means of analogue mobile telephony,

- having active e-mail post,

- Internet website allowing for displaying hypertext documents (HTML) on the computer screen connected in the Internet network with the network service www Internet Explorer in version 6.0 or newer with activated operation of Java applets or 
 Mozilla Firefox in version 2.0 or newer with activated operation of Java applets or Opera in version 9.0 or newer with activated operation of Java applets or 
 Google Chrome in version 2.0 or newer with activated operation of Java applets or Apple Safari in version 3.0 or newer with activated operation of Java applets 
, minimum screen resolution 1024 x 768 pixels.

Chapter 4: The service consisting in placing an order with the use of the electronic order form and active e-mail post.

1. The procedure connected with concluding the sales contract (online mode) with the use of electronic order form starts on the moment on which the Customer chooses the product they are interested in and, next, clicks on its photo.

2. In the sheet of the displayed product, the Customers can make themselves familiar with the product features, application in its description as well as in the enclosed product specifications.

3. Upon selecting a product, the Customer defines its ordered quantity and, next, confirms this action with “to basket” button.

4. Upon performing the action included in point 3, the stage process connected with placing an order is performed, including:

STEP 1: BASKET CONTENTS (description of the ordered product - type of cream, quantity of ordered product)

STEP 2: ORDERING OPTIONS (with account creation option, without the necessity to create the account, by option of logging in within the created account)

STEP 3: PERSONAL DATA (electronic form, with option of convenient text edition, allowing for introduction of personal data necessary for order completion)

STEP 4: DELIVERY DETAILS (option allowing for introduction of additional delivery address in case when it is different from the submitted correspondence address)

STEP 5: DELIVERY METHOD (option allowing for selection of available delivery methods with indication of potentially incurred costs of transport)

STEP 6: PAYMENT METHODS (payment methods with selection option, made available by the Seller in the scope of sales contracts concluded remotely)

STEP 7: ORDER CONFIRMATION (summary of the placed order with the tab informing on the fact that the order imposes the payment obligation - “I order and pay”)

5. The Customer, at the first stage of placing an order (STEP 1), choosing to create the account, acts according to the procedure included in chapter 5 of these e-service regulations.

6. Data necessary for order completion is included in PERSONAL DATA form (STEP 3) which must be filled in with:

FAX (this field is not obligatory),

CORRESPONDENCE/DELIVERY ADDRESS,

NIP (in case of an entrepreneur)

7. During next stages of placing an order, the Customer selects one of the available delivery and payment methods made available by the Service Provider and also specified in the sales Regulations.

8. The process of order placement, upon it summary (definition of product, price, delivery cost), is finalised by pressing “I ORDER AND PAY” button and ticking the checkbox with the declaration on having read the content of the currently effective sales regulations and advisement on the right to withdraw from the contract, with downloadable and read-only version.

9. A confirmation of accepting the order for performance with all its components (order number, selected delivery and payment form, personal data, product - name, type, price, delivery cost) as well as the information on the right to withdraw from the contract are sent to the Customer’s e-mail address indicated in the electronic form.

Active e-mail post (procedure of order placement)

10. The order can be also made by sending the content of the offer with the following data directly to the Service Provider’s address:

- indication of the product, including specification of its type and ordered quantity,

- price for the indicated product,

- selected payment form for the product,

- personal data (name and surname, e-mail address, telephone number, delivery address)

11. The Service Provider immediately confirms the receipt of the placed order, sending the information on accepting the order for performance to the Customer’s address.

12. The e-mail message, included in point 2, contains information on the order number and its significant components which constitute the data specified in point 10 of these e-service regulations.

Chapter 5: The terms and conditions of creation of the account in the Internet shop in the scope of the service provided with electronic means.

1. In the scope of services provided with electronic means, the Customers have the possibility to create the free account the functionality of which consists in administration and management of one’s own personal data in the process of order placement.

2. The Service Provider, in the scope of the created account,, makes available the services directly conducted by the Customer and consisting in: introduction/modification of dispatch data, submitting data for the invoice, view of history of placed orders, change of access to the created account by updating the password.

3. In order to perform the registration allowing for creation of the account, it is necessary to click tab “MY ACCOUNT” available on the website and, next, tab “Create the account”.

4. Upon performing the action included in point 3, the system displays the registration form with the possibility of convenient text edition, including the following data fields:

PASSWORD (individually established for an indicated login, can include lower and upper case letters, digits, special characters - for safety reasons, it is recommended that it consists of at least 8 characters)

5. The registration form also includes two fields in the form of a chechbox:

- the first one with information on the regulations of service provision with electronic means (e-service regulations) effective on the moment of account creation - with a downloadable and read-only version,

- the second one with provision of consent for receiving the information bulletin newsletter (this field is not obligatory)

6. The registration process connected with the creation of the account is completed with clicking button “CREATE THE ACCOUNT”.

7. The e-mail message, confirming the account creation, is sent to the Customer’s e-mail address submitted during the registration process.

8. At the next logging stages, on the Internet shop’s website. it is necessary to type in the login chosen and individual password selected during the registration process in the right fields.

9. The account can also be created in the process of order placement, according to the procedure specified in chapter IV of these Regulations.

Chapter 6: The service provided with electronic means, consisting in sending the Information bulletin - Newsletter.

1. The subscription of the information bulletin newsletter, as information on products, promotions, competitions organised by the Service Provider in the scope of the conducted Internet shop, is performed in the following modes:

- during the process of registration and order placement by clicking the checkbox with the following content:

“Yes, i want to receive the information on novelties and promotions of the Internet shop www.nidiesque.pl and, for this purpose, i provide my consent for processing my e-mail address by the Service Provider for the purposes of the service of newsletter subscription. I made myself familiar with the advisement on the right to access my data and possibility of their correction. I am aware that my consent can be withdrawn at any time, which results in removal of my e-mail address from the distribution list of the newsletter service”

- by filling in the field with e-mail address on the home page and, next, clicking the checkbox with the declaration:

“I want to receive the information on novelties and promotions of the Internet shop www.nidiesque.pl and i provide my consent for processing my e-mail address by the Service Provider for the purposes of the service of newsletter subscription”,

2. The e-mail with the link confirming the intention of subscribing for the newsletter distribution list is sent to the Customer’s e-mail address.

3. Confirming the link included in point 2 results in subscribing the Customer to the list of subscribes of the newsletter of the Internet shop operating under domain www.nidiesque.pl

4. The withdrawal of the consent for processing the e-mail address sent to the Service Provider can be made in amy form, which results in cessation of subscription of the “Newsletter” bulletin. More information on the scope of processing personal data for marketing purposes can be found in the “Privacy policy” document.


Chapter 7: The terms and conditions of service provision with electronic means, consisting in keeping the account in the Internet shop

1. The contract for service provision with electronic means, consisting in keeping the account in the Internet shop, which is the contract for the unspecified period of time, with continuous nature, can be subject to termination.
2. The Customer can terminate the contract by sending the relevant declaration to the e-mail address: info@nidiesque.pl or in writing to the Service Provider’s correspondence address.
3. The Service Provider can terminate the contract for service provision with electronic means concluded for the unspecified period of time, with continuous nature, if the Customer submits contents with the unlawful nature.


4. The contract expires upon the lapse of 7 days upon the submittal of the declaration of will on its termination by the Customer.

Chapter 8: The methods and technical measures used for detection and correction of mistakes in introduced data

1. In the process of order placement with the use of an electronic order form, there is a possibility of convenient edition of introduced data as well as of change of the suject of order till the moment “I order and pay” button is pressed.

2. Upon the order is placed and accepted for performance (the Service Provider sends the electronic message to the e-mail address submitted by the Customer), it is possible to make correction in the introduced data, verify it, remove a mistake by: sending the e-mail message to the Service Provider’s electronic address.

3. In case of detection or intention of correction of a mistake in the placed order, the client/Customer has the right to change it within 12 hours upon the receipt of the e-mail confirming the acceptance of the order for performance.

4. When the order correction is made, the Service Provider sends the e-mail message with confirmation of the performance of the scope of change corrections, arising from the request specified in point 2, to the Customer’s electronic address.

Chapter 9: The mode of complaint procedure

1. The Service Provider takes actions that are necessary for correct and fully efficient operation of the Internet website in the scope which results from the current technological knowledge, including IT knowledge, and undertakes to remove all irregularities raised by Customers.

2. The Customer can place complaints connected with service provision by electronic means through the Internet website by sending the e-mail message to the Service Provider’s e-mail address.

3. In the e-mail address, specified in point 2, it is necessary to provide as much information and circumstances relating to the subject of complaint as possible, including the Customer’s data (telephone number, e-mail address) as well as indication of the date on which irregularity occurred.

4. The Service Provider shall immediately provide the response to the complaint, not later than within 14 days. The response to the complaint is sent to the e-mail address submitted by the Customer or in the other manner specified by him.

Chapter 10: The aim and range of processing personal data of natural persons using the services provided with electronic means in the scope of conducted Internet website

1. The administrator of the personal data of Customers/clients who use and visit the Internet website, operating under domain www.nidiesque.pl, is the Service Provider who decides on the purposes and resources of processing personal data in relation to the conducted business activity.

2.In connection with the conclusion and, next, performance of the sales contract, the Service Provider processes the necessary Customers’ personal data the scope of which is specified by the provisions of the Act of 18 July 2002 on service provision with electronic means.

3. The data specified in point 2 incude:

- name and surname,

- delivery/correspondence address,

- E-mail address,

- contract phone number.

4. The submittal of the data specified in point 3 is optional, however, their lack results in refusal to provide the service with electronic means in the scope of conclusion of the sales contract for the products presented in the Internet shop.

5. In connection with the order performance, including delivery of the purchased product, clients’ personal data, such as: name and surname, delivery address, contact telephone are transferred (depending on the selected delivery method) to courier companies which, in the scope of the conducted enterprise, deal with professional parcel delivery.

6. The Customer’s personal data can be processed for marketing purposes only if the provides his consent for this purpose.

7. In cases specified in point 6, the Service Provider makes available the appropriate checkbox field with the description of the scope and purpose of processing the Customer’s personal data.

6. The potential consent for processing personal data is optional and can be withdrawn at any time.

7. Particular information concerning processing personal data is included in the “Privacy policy” document.

Chapter 11: Contact point

1. The Customers can use the information on services provided with electronic means in the scope of the contact point conducted by the competent minister for economy on the website www.biznes.gov.pl.

2. The contact point, specified in point 1, provides answers to inquiries of service providers and customers in Polish or English in the following scope:

- rights and duties of service providers and customers,

- complaint procedures and repair of the damage in case of existing disputes,

- provision of information on the competent bodies, associations or organisations providing practical help in connection with service provision with electronic means.

Chapter 12: Final Provisions

1. The provision of the services, specified in these regulations, with electronic means is performed in Polish and under the law effective in the Republic of Poland (RP).

2. Potential disputes which arise between the Service Provider and Customer are subject to competent courts under the provisions of the Act of 17 November 1964 Civil Procedure Code.

3. To all mattes not settled in these Regulations the legal provisions apply, in particular:

- Act of 18 July 2002 on service provision with electronic means,

- Act of 29 August 1997 on personal data protection,

- Act of 23 April 1964 Civil Code

- the regulation of the Minister of Economy of 17 August 2010 on establishment of the contact point for administration and contact point for service providers and customers.

4. The Service Provider allows for amendment of the provisions of these Regulations due to important reasons, in particular, in case of:

- change in the graphic layout of the website operating under domain www.kfniccolum.pl which has impact on, e.g. manner and terms and conditions of service provision with electronic means,

- changes in the scope of effective legal regulations referring to electronic commerce, including services provided with electronic means,

4. Amendments become effective within 14 days upon their publication on the website with indication of the date of change publication and the date on which they become effective.

5. If the Customers use the services provided with electronic means, in the scope of concluded contacts, the consolidated text of the amended Regulations is sent to them to the e-mail address submitted by them. In case of lack of acceptance of the amended regulations, the Customers can terminate the contract for service provision with electronic means with immediate effect within 14 days upon the receipt of the e-mail.

6. The content of these Regulations is available on the website: www.kfniccoulum.pl 7. The Regulations can be turned into a hard copy, obtained and read at any time by printing, saving on the appropriate carrier or downloading them from the website www.nidiesque.pl and saving in the computer memory. However, in each case, upon the Customer’s request, the e-service regulations are sent in the manner which allows him to obtain, read and turn the content of the regulations into a hard copy with the tele-information system used by the requesting Customer.

8. The following items presented on the Internet shop’s website: graphic outlay, photos, contents and product descriptions cannot be modified, copies and distributed without the Service Provider’s consent.

9. The regulations become affective on 2 May 2017.
